A federal campaign finance enforcement matter opens on a sworn complaint, an internally generated referral or a referral from another agency. The respondent is notified and may respond in writing before any finding. The Commission then votes on whether there is reason to believe a violation occurred, may investigate, votes again on probable cause after a brief from the General Counsel and a reply, and must attempt conciliation before authorizing suit.
The enforcement section may seek information, require production of the verification forms, inspect premises and take testimony, with access to books, records, systems and witnesses. It must decide within 120 days whether to file a complaint and notify both parties if it does not. An order may require cease and desist, hiring with or without back pay, civil penalties per individual, notices, training, record retention and removal of adverse personnel entries.
A final nonconfirmation means the system could not confirm work authorization after the contest period ran or the worker's efforts did not resolve the discrepancy. The employer must close the case, and may close it either by terminating the employment or by continuing to employ the worker and recording that choice. Continuing employment removes the statutory presumption of good faith and is reported to the administering agencies.
The definition of a final official statement requires it to describe any instance in the previous five years in which a person specified in a continuing disclosure undertaking failed to comply, in all material respects, with a previous undertaking. That statement travels with the issuer through every subsequent offering in the period, and an inaccurate or incomplete version of it is itself a misstatement in the offering document.
A notice of suspect documents advises the employer that, on the agency's review of the forms and the documentation submitted, the documents presented by named employees do not relate to those employees or are not valid for employment. It also advises of the criminal and civil consequences of continuing to employ unauthorized workers. The agency provides both the employer and the named employees an opportunity to present documentation showing the finding is mistaken.
A designated trustee takes office by accepting, either in the manner the trust instrument prescribes or by accepting delivery of trust property, exercising a power, or performing a duty. Acceptance carries the duties of loyalty, prudence, recordkeeping and reporting from the moment it occurs. A person who does not wish to serve must decline within a reasonable time; silence past that point is treated as rejection, and the vacancy is filled in the order the instrument and the statute specify.
Adequacy asks whether the representative parties will fairly and adequately protect the interests of the class. It examines conflicts between the representative and absent members, the representative's engagement with the litigation, and separately the qualifications of counsel. A court certifying a class must appoint class counsel, considering the investigation done, counsel's experience and knowledge, and the resources to be committed.
The Investment Advisers Act excludes from the definition of investment adviser any broker or dealer whose advisory performance is solely incidental to the conduct of its brokerage business and who receives no special compensation for that advice. A firm outside the exclusion is an adviser and must register as one. Many firms are registered in both capacities, and the applicable rules then depend on the capacity in which a particular recommendation is made, which the firm must disclose.
A cost of service study divides the revenue requirement among customer classes in three steps. Costs are functionalized into production, transmission, distribution and customer categories; classified as demand-related, energy-related or customer-related; and allocated to classes using factors that reflect each class's contribution to the cost driver. Commissions then temper the indicated movement through gradualism.
Where a form or an entry is completed late, the correction is made by lining through incorrect information, entering the correct information, and initialing it. An omitted certification date is filled with the current date and initialed rather than backdated. Only the employee, or a preparer or translator, may correct the employee's section. A written explanation is attached, and changes are never concealed by erasure or correction fluid.
A court of appeals may permit an appeal from an order granting or denying class certification, but not from an order merely directing notice of a proposed settlement. A petition must be filed with the circuit clerk within fourteen days after the order is entered, extended to forty-five days where the United States or a federal officer or agency is a party. The appeal does not stay proceedings below unless a court so orders.
A beneficiary who receives a trust accounting may approve it, object to it, or do nothing, and the third option is not neutral. Under the uniform limitation provision a report that adequately discloses a potential claim starts a short period, commonly two years, against the recipient. Consent, release or ratification bars a claim outright, but only where the beneficiary knew the material facts and the consent was not induced by improper conduct.
